I.1  The Operating Regulations of the 5D cinema – CINEMA MAXIM (hereinafter “Operating Regulations”) are mandatory for all spectators and persons accompanying the spectators (hereinafter “the Spectator”) of a film performance held in a cell of the 5D cinema – CINEMA MAXIM (hereinafter “the 5D cinema”), which is operated by Duo Dark green s.r.o., ID 09378898, based in třída Kpt. Jaroše 1922/3, Černá Pole, 602 00 Brno, registered in the Commercial Register at the Regional court in Brno under file No. C 118533 (hereinafter “the Operator”).

I.2  In the 5D cinema, special performances of 5D films are carried. In a cell of the 5D cinema, there are 4 seats for Spectators. The seats move by happening on the canvas. The production is supplemented with other additions (rain, steam, bubbles etc.). The Spectators are lent 3D glasses for watching a film performance. The 3D glasses are provided to the Spectator after paying admission to the 5D cinema staff. The individual film productions last no longer than 15 minutes.

I.3  The 3D glasses are the property of the Operator. They are provided to the 5D cinema spectators on loan only for the duration of film production. 3D glasses are lent free of charge and may not be used for any purpose other than that for which they were lent. The Spectator is obliged to check the glasses are not damaged. Each Spectator is obliged to hand over the glasses back to the staff after the performance. If the Spectator causes damage to the 3D glasses by improper handling, he is obliged to compensate the damage caused to the Operator.

I.4  The Spectator is obliged to behave so as to not disturb other Spectators by inappropriate behavior and undertakes to obey the organizational instructions of the 5D cinema staff. Reckless or intoxicated Spectators can be expelled from the 5D cinema by the 5D cinema employees without a compensation of the admission or even prevent them from entering the 5D cinema.

I.5  During a screening of a film, the Spectator must not leave his seat. If the Spectator wants for any reason to leave his seat, he can do so only by pressing the alarm button, thereby interrupting the projection.

I.6  The Spectator who is under the influence of alcohol or psychotropic substances will not be let into the 5D cinema.

I.7  The Operator informs the Spectator that participation in screening films in the 5D cinema is suitable from the age of 4 years.

I.8  The Operator informs the Spectators that the projection of films within the 5D cinema is not suitable for people suffering from psychosis or neurosis. Screenings of films are also not suitable for people having problems or being treated with the musculoskeletal system. These persons expressly waive any claims against the Operator in respect of any potential damage they may suffer.

I.9  For hygienic reasons, it is forbidden to bring and consume any food in the 5D cinema.

I.10  For underage Spectators or damage caused by them is liable their legal representative. The legal representative of an underage Spectator is obliged to comply with the responsibilities set out in the Operating Regulations for underage Spectators.

I.11  On the basis of the law on public health protection, the Operator warns that if Spectators are not satisfied with the level of noise in the 5D cinema, they have the right to report this to the responsible persons who are obliged to arrange an immediate remedy.

I.12  The Operator is not responsible for personal belongings left by the Spectators freely in areas of the 5D cinema.

I.13  Together with the 5D cinema’s cell, the Operator also owns its equipment. The production of films in the 5D cinema is treated with copyrights to the projected films. The Operator prohibits using any recording equipment and carrying out any records of the 5D cinema’s production.

I.14  The cell of the 5D cinema, facilities of the cell, and a business unit are furnished so as to avoid the possibility of injury to the Spectators, staff or equipment damage. The entire business unit of the 5D cinema is monitored by a camera system capable of keeping CCTV recording. The records are used for supervising the unit if necessary, and cameras inside the cells themselves transmit the image to the employees who ensure the smooth operation of the 5D cinema. Before the 5D cinema’s projection opening, the Spectator is entitled to disclose that he does not want to be monitored by CCTV or taken photos of him. In this case, it may happen that the employees do not allow the Spectator to undergo screening of the 5D cinema. The Spectator also gives the Operator his consent with capturing the image of visitors of the 5D cinema during screenings of the 5D cinema as well as the acquisition of video record during the 5D cinema’s projections inside the cinema. The acquirer may subsequently use these photos for the presentation of the 5D cinema or like. The photos can also be published on the website of the Operator. Published pictures are carefully selected and are not linked to any other personal information of the disclosed person. The Spectator may at any time revoke his consent to the use of these photos, the withdrawal of the consent must be written and sent to the Operator’s address.

I.15  Fire safety is determined by the internal regulations of the shopping center and all employees must abide by this regulation. In the case of fire or suspected fire, the employees are obliged to try liquidating the presence of the fire using extinguishing equipment available, ensure summoning fire units, report the fire and proceed according to the directives of the fire alarm and evacuation plan.

I.16  Throughout the day of 5D cinema’s operation is performed wet-mechanical cleaning – repainting seats, table, and chairs. Also, 3D glasses are disinfected after each use. Each day after the operation is carried out the wet mechanical cleaning of retail space – cleaning, washing floors, cell compartment – seats, floors, backgrounds.

I.17  The Spectator is obliged to check his tickets immediately at the cash register, no subsequent complaints will be taken into account. The purchased tickets may not be returned or exchanged. An entry into the 5D cinema’s premises is possible only after the purchase of a valid ticket. After the screening of the film, the Spectator is required to leave the 5D cinema’s premises.

I.18  In the event of a breach of any provision of the Operating Regulations, the Spectator is aware of the fact that he may be immediately expelled from the 5D cinema by the 5D cinema staff with no entitlement to a refund of paid admission.

I.19  By purchasing tickets the Spectator confirms his familiarization with the Operating Regulations of the 5D cinema and declares that he understands the Operating Regulations, agrees with them and undertakes to comply with all obligations and conditions laid down in the Operating Regulations. Exceptions to this Operating Regulations may provide only the Operator.

I.20  The Operating Regulations become effective on January 1, 2016.
